Industrial land-use reclassification in Tamil Nadu

Acts
Tamil Nadu Town and Country Planning Act 1971, Tamil Nadu Town and Country Planning (Amendment) Act 2025
Authority
CMDA, the local planning authority or DTCP, as the notified boundary and the application type provide; not decided by district name alone
Last reviewed
2 October 2026

Who this applies to

  • A patta or A-register entry records revenue classification. It does not, by itself, vary the master plan.
  • Reclassification is a change to the statutory land-use plan. A section 38 question is whether reserved land was acquired in time. Release is not automatic industrial zoning.
  • Tamil Nadu Act 38 of 2025 amended the Town and Country Planning Act, 1971. G.O. (Ms.) Nos. 166 and 167 dated 28 October 2025 deal with commencement and the online portal.
District no-objections are a different page. This page is the planning-zone question. Building permission is a further application even where industrial use is already permissible.

Which question you are asking

Several questions tend to get run together here: a parcel's revenue classification, its statutory planning zone, its release from a reserved acquisition, and permission to build on it. They are separate. A patta, or an industrial use somewhere else on the same road, does not replace a survey-specific extract from the notified master plan or detailed development plan.

QuestionWhat it decides
Revenue entry (patta, A-register)What the revenue record says about classification and title. Not, by itself, a planning variation.
Master plan or detailed development planWhether industrial use is permitted, conditional or prohibited on that subdivision.
Reclassification or plan variationWhether the statutory plan itself has to be changed, by the authority and the process that apply.
Section 38Whether reserved or designated land was acquired in time. A release does not automatically grant industrial zoning or permission to build.
Planning and building permissionEven permissible industrial use still needs the development and building applications, unless a documented exemption applies.

Tamil Nadu Act 38 of 2025 amended the Town and Country Planning Act, 1971 and came into force on 28 October 2025 (G.O. Ms. No. 166, Housing and Urban Development, 28 October 2025). Applications to develop land, change its use or obtain a completion certificate anywhere in Tamil Nadu are made through the online Single Window Portal at https://onlineppa.tn.gov.in/SWP-web/login (G.O. Ms. No. 167, same date). The portal is a filing route: it does not approve the application, and it does not set a universal processing period. A further amendment, Tamil Nadu Act 14 of 2026, changes section 47-A, including the Collector's role for wetlands, from a date the Government will notify.

Whether land recorded as wet land or as agricultural can be developed is still partly a Revenue Department question, separate from planning permission. But there is no single Collector conversion that produces industrial zoning, and the district no-objections that some rules call for are not this reclassification either.

What it costs to get wrong

Building, or buying on the assumption that you may build, before the plan allows the use, leaves you with a site you cannot lawfully develop. This page does not state a penalty. A pending reclassification is not permission to start industrial work the current plan does not allow. Planning permission and the building permit remain separate even after the use is permissible.

The process

  1. Assemble the survey-specific record

Collect every subdivision, the current field measurement sketch, the A-register, patta and ownership papers, the access, and the planning boundary. Then retrieve the operative master-plan and detailed-development-plan sheets, with proposed roads, reservations, waterbodies and special constraints.

  2. Name the planning authority from the notified boundary

Confirm whether the land falls in the Chennai Metropolitan Development Authority area, a local planning authority area or a Directorate of Town and Country Planning area, and whether any delegation applies. The district name alone does not settle it.

  3. File the relief that matches the legal question

Decide which you actually need: a permissibility clarification, a reclassification, a plan variation, a section 38 release or a revenue remedy. Use the current form and the notified portal, with the layout, ownership papers and any published notice the rules require. A 2024 land-use procedure on the planning portal predates the October 2025 changes, so reconcile it with the 2025 Act and the portal before you follow it.

  4. Only then apply to build

Where a change of use is required, it is made by the Government Order, Gazette notification or plan modification, not by the building permit. The building application, and the factory, pollution, fire, access and groundwater filings, then follow under their own statutes.

Common failure points

  • Reading a patta as industrial zoning.
  • Asking the Collector for a conversion when the obstacle is the master plan.
  • Treating a section 38 release as permission to construct a different use.
  • Missing a road widening that crosses only part of the survey number.
  • Assuming an industrial-estate allotment removes planning, pollution and factory approvals.

Send us the survey subdivisions and the planning extract. We will tell you whether you need a reclassification, a section 38 reading, or only a planning application.
